TrueView Cards Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TrueView Cards website, applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Company and DBA disclosure

TrueView Cards is a "doing business as" name ("DBA") of 150 Manchester, LLC ("Company," "we," "us," or "our"). These Terms are an agreement between you and the Company.

2. Definitions

For purposes of these Terms:

  • "Buyer" means a user who purchases or attempts to purchase an item through the Service.

  • "Seller" means a user who lists an item for sale through the Service.

  • "Listing" means a posting for an item.

  • "Order" means a purchase transaction initiated through the Service.

  • "Content" means any text, images, videos, listings, messages, reviews, or other materials submitted through the Service.

  • "AI Tools" means software tools that may provide video capture, condition analysis, or other automated insights.

  • “TrueView Score” means a numeric condition score on a 1–10 scale displayed on certain Listings.

3. Eligibility and accounts

You may use the Service only if you can form a binding contract in your jurisdiction.

Account registration. You may need an account to use certain features. You agree to provide accurate information and keep it updated. You are responsible for activity under your account and for maintaining account security.

Account actions. We may suspend or terminate accounts, or remove Content or Listings, if we believe there is fraud, abuse, policy violations, risk to the Service, or a breach of these Terms.

4. The Service and who the seller is

The Service and our role. TrueView Cards does not take possession of items and does not act as the Seller. Any purchase made through the Service is a transaction directly between the Buyer and the applicable Seller, and TrueView Cards is not a party to that contract.

What the Service provides. TrueView Cards provides tools, payment processing facilitation, listing features, communication channels, and informational scoring to help Buyers and Sellers complete transactions. TrueView Cards is not responsible for shipping, delivery, payment disputes, or the actions or omissions of any Buyer or Seller, except where required by law.

What the Service is not. TrueView Cards is not an agent, broker, escrow service, insurer, or guarantor. We do not verify ownership of items or guarantee that a Seller will ship an item or that a Buyer will pay for an item. We may, at our discretion, assist with dispute resolution or provide support, but we have no obligation to do so.

Communication. Buyers and Sellers may communicate through the Service to discuss Listings, ask questions, and coordinate aspects of a transaction. Messages are not monitored in real time. TrueView Cards is not responsible for the content of messages between users, including accuracy, representations about condition, authenticity, or promises made. Users are solely responsible for their communications and any agreements reached outside the Service.

5. Listings, Scores, authenticity, and grading

TrueView Scores. Certain Listings may include a numeric TrueView Score (1 through 10) that reflects the Company’s assessment of the card’s condition. TrueView Scores may be assigned through manual review by the Company, through automated systems, artificial intelligence models, or a combination of both. The method of evaluation may change over time without notice, and the Company does not guarantee the use of any particular scoring method, tool, or technology. Scores are assigned at the time of listing and may not be updated after purchase.

Informational only. TrueView Scores are informational and represent the Company’s opinion at the time of evaluation. They are not appraisals, certifications, guarantees, or professional grading services. TrueView Scores do not represent or predict the grade a card may receive from PSA, BGS, CGC, SGC, or any other grading service.

Subjectivity and variance. Condition evaluation involves judgment, and reasonable differences of opinion can occur. Minor discrepancies between a Buyer’s expectations and a TrueView Score do not constitute a material error. TrueView Scores may vary if reevaluated by a person or system, and the Company is not obligated to update or revise a score.

Seller information. Sellers may provide additional descriptions, opinions, or photographs. The Company does not guarantee the accuracy of seller-provided information and is not responsible for misrepresentations made by Sellers. Buyers must review Listings carefully and are encouraged to ask questions using the messaging features available on the Service.

Authenticity and counterfeits. The Company aims to identify and avoid counterfeit items but does not guarantee authenticity. If you believe an item is counterfeit or materially misdescribed, you must follow the Claims process described in Section 9.

No grade equivalence. Any references to third-party grading standards or terminology are for descriptive context only. TrueView Scores are not equivalent to any grade or grade range, and do not imply a likely outcome if a card is submitted to a grading company.

6. AI tools and informational analysis

The Service may include AI Tools. AI Tools may help provide informational estimates, not guarantees. AI Tools are not professional authentication, appraisal, grading, legal, or financial advice. You remain responsible for verifying an item’s authenticity and condition before buying or selling.

7. Orders, pricing, payments, fees, and taxes

Availability and errors. Items may be mispriced, described inaccurately, or unavailable. We may correct errors, inaccuracies, or omissions and update information at any time.

Payouts. Sellers must create and maintain an active Stripe account and connect a valid bank account to receive payouts. Payouts are issued by Stripe directly to Sellers. TrueView Cards does not hold, manage, transfer, or control payout funds and is not responsible for delays, holds, account verification, or other actions taken by Stripe.

Sellers must comply with all applicable Stripe terms and policies. If a Seller’s Stripe account is suspended, restricted, or closed, payouts may be delayed or prevented, and TrueView Cards is not responsible for any resulting losses.

Payments. Payment can be made through payment methods made available through the Service. We may use third-party payment processors, which have their own terms and limitations. Payment cards are subject to validation checks and authorization by your card issuer. If authorization is not received, the Order will not be completed. TrueView Cards does not control payment authorization or settlement timing.

Service fees. We may charge fees (and applicable taxes) for use of the Service or for Orders. Applicable fees will be shown during checkout or in the Seller flow. We may change fees at any time.

Taxes. You are responsible for any taxes associated with your purchases or sales, except where the Service is required by law to collect and remit taxes. We may issue tax forms when required.

8. Shipping and delivery

Shipping terms, handling times, tracking, signature requirements, and packaging standards may be described in the Listing or checkout flow.

Shipping, handling, and delivery are solely the responsibility of the Seller. TrueView Cards does not take possession of items or ship items. Any shipping issues, delivery failures, lost packages, delays, or damage must be resolved directly between Buyer and Seller.

Risk of loss. Unless required otherwise by law, risk of loss transfers to the Buyer upon delivery by the carrier to the address provided in the Order.

Wrong address and failed delivery. Buyers are responsible for providing accurate shipping information. If a package is returned due to an incorrect address or failed delivery, the Buyer and Seller are responsible for resolving the issue directly, including whether to reship and who bears the cost. TrueView Cards may, at its discretion, assist with communication or provide platform support, but has no obligation to do so.

Tracking required. Sellers must ship Orders using a shipping method that includes tracking. Sellers are responsible for providing the Buyer with the tracking number through the Service and for packaging the item appropriately.

Delivery confirmation. Carrier tracking information showing delivery (including delivery scans, GPS or address confirmation where available, or signature confirmation where required) will be treated as proof of delivery to the address provided in the Order.

9. Disputes; claims process; chargebacks

Buyer-Seller resolution first. Buyers and Sellers must make reasonable efforts to resolve disputes directly with each other before requesting assistance from TrueView Cards.

Claims. If a Buyer believes an item is not authentic, is materially different from the Listing description (a “Claim”), the Buyer must notify the Seller through the Service within 48 hours of delivery (or a longer period if required by law) and provide reasonable evidence to support the Claim. TrueView Cards may be copied or contacted for additional support.

Required evidence. Evidence may include a continuous unboxing video showing the sealed package, label, opening, and the item, clear photos of the item (front, back, corners, edges), and packaging or label details.

Returns and refunds. Any return, refund, replacement, or other remedy is the responsibility of the Seller and Buyer, unless TrueView Cards explicitly agrees in writing to provide a platform-facilitated remedy. TrueView Cards does not guarantee outcomes and is not obligated to provide refunds or accept returns.

Platform actions. TrueView Cards may, at its discretion, assist with communication, request information, and take Service actions (including warning, limiting, or suspending accounts) based on suspected fraud, policy violations, or repeated disputes.

Chargebacks. Buyers agree to attempt to resolve disputes with Sellers through the platform before seeking a chargeback. Submitting a chargeback without following the dispute process may result in account limitations, suspension, or denial of future claims.

Item Not Received (“INR”). If a Buyer claims an Order was not received, the Buyer must submit an INR claim within 48 hours of the carrier marking the shipment as delivered (or a longer period if required by law).

Delivered scan presumption. If carrier tracking shows the Order was delivered to the address provided in the Order (and includes delivery confirmation details such as delivery scan, GPS, or address confirmation where available, or signature confirmation where required), the Order will be treated as delivered, and the INR claim will be denied unless the Buyer provides credible evidence of non-delivery.

Evidence for INR claims. The Buyer may be required to provide additional evidence, which may include: (a) confirmation that the shipping address in the Order was correct, (b) confirmation that the Buyer checked with household members, building staff, and nearby delivery locations, (c) a written statement describing the circumstances, (d) a police report number or mail theft report where appropriate, and/or (e) a carrier case or investigation number.

Seller cooperation. Sellers agree to reasonably cooperate in investigating INR claims, including providing shipping receipts, tracking details, and any carrier claim documentation reasonably requested.

Return authorization (RMA). If a Seller agrees to accept a return, the Seller may require a return authorization and may require the Buyer to ship the return with tracking and any additional shipping requirements stated in the Listing or communicated through the Service.

Same item requirement; no swaps. Any returned item must be the exact same item originally shipped by the Seller and must be returned in the same condition (reasonable handling excepted). If the Seller determines the returned item is not the same item or has been materially altered, the Seller may deny the return and any refund.

If a return is denied. If a Seller denies a return because the item is not the same item or has been materially altered, the Seller may (at the Buyer’s expense) ship the item back to the Buyer using a tracked method, and no refund will be issued.

Return evidence. To prevent fraud, the Seller and/or TrueView Cards may require evidence for returns, which may include: (a) a continuous video of the Buyer packaging the item for return, (b) clear photos of the item (front, back, corners, edges) before packing, and (c) photos of packaging and shipping label details.

10. User Content and feedback

You retain ownership of Content you submit, but you grant the Company a worldwide, royalty-free license to host, store, reproduce, display, distribute, and use your Content for operating, improving, and marketing the Service.

You are responsible for your Content and represent that you have the rights to submit it.

Feedback. If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation.

11. Intellectual Property and DMCA

The Service and its content (excluding user Content) are owned by the Company or its licensors and are protected by intellectual property laws.

If you believe Content infringes your copyright, send a written notice to our copyright agent at [email protected] and include: (a) your signature, (b) identification of the copyrighted work, (c) identification of the allegedly infringing material and where it appears on the Service, (d) your contact information, (e) a good-faith statement that use is not authorized, and (f) a statement under penalty of perjury that the notice is accurate.

TrueView Cards is an independent marketplace and is not affiliated with, endorsed by, sponsored by, or approved by Nintendo, The Pokémon Company, The Pokémon Company International, Inc., GAME FREAK inc., Creatures Inc., or any of their affiliates. Pokémon and all related names, marks, logos, and characters are trademarks of their respective owners. Any references to Pokémon are used solely to identify the products being listed and discussed on the Service. Use of these trademarks does not imply any affiliation with or endorsement by the trademark owners.

12. Prohibited conduct

You may not:

  • use the Service for fraud, chargeback abuse, money laundering, or deceptive conduct
  • list counterfeit, stolen, illegal, or infringing items
  • impersonate another person or entity or misrepresent affiliation
  • attempt to hack, scrape, reverse engineer, or disrupt the Service
  • post unlawful, threatening, defamatory, or obscene Content
  • infringe or violate the rights of others
  • upload Content that infringes third-party intellectual property rights. We may remove allegedly infringing Content and terminate repeat infringers.
  • misrepresent a TrueView Score as a guaranteed grade or grade equivalent, or make misleading condition claims inconsistent with the Listing
  • submit false “item not received” claims, engage in return fraud, or attempt to swap or substitute a different item during a return or claim process

13. Termination

We may suspend or terminate your access to the Service at any time for any reason, including suspected fraud, violation of these Terms, or risk to the Service. Sections that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, and indemnification).

14. Disclaimers

THE SERVICE (INCLUDING ANY AI TOOLS) IS PROVIDED "AS IS" AND "AS AVAILABLE" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA OR OTHER INFORMATION, BUSINESS INTERRUPTION, PERSONAL INJURY, OR LOSS OF PRIVACY) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SERVICE.

THE COMPANY’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU THROUGH THE SERVICE IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR 100 USD (OR ITS EQUIVALENT) IF YOU HAVE NOT PURCHASED ANYTHING THROUGH THE SERVICE.

16. Indemnification

You agree to indemnify and hold harmless the Company and its owners, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Service, your Content, your Listings, your Orders, or your violation of these Terms.

17. Governing law and venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules. The exclusive venue for disputes will be the state or federal courts located in Kent County, Delaware, unless applicable law requires otherwise.

18. Changes to these Terms

We may update these Terms. If we make material changes, we will take reasonable steps to provide notice. Your continued use of the Service after changes become effective means you accept the updated Terms.
